My stamp H1B visa and I797 is valid till 08/25/2021. We recently discovered that the I-94 expiration date was same as my old passport expiration date of 8/25/2020. I renewed my passport before it expired but my I-94 expired on 08/25/2020. i.e more than 180 days.I discovered I-94 expired while submitting documents for H1B extension.Recently I found out that my i-94 has expired ( which was truncated due to my passport expiring ) , but my I-797 is valid . So I am basically out of status for more than 180 days . I tried approaching the CBP office but they said its not their mistake so they wont fix it .
